Immigration Application Denied By USCIS? 3 Steps From An Immigration Attorney in Los Angeles

What happens if the government denies your immigration application? Here are three things that you can do if you receive a bad decision from USCIS.

USCIS Denied Immigration Application

So, what happens if USCIS has denied your application? Here are three things that you can do:

  1. You can potentially file a motion to reopen or appeal the decision. If you believe that the government has applied the facts wrong to your case, the law wrong to your case, or if you have new facts that you’d like to show them, you could potentially submit this, and have them change their mind.
  2. You might be able to just apply for the relief again. This is not always available, but if it is, and you were not eligible before but you are now, you may just want to file the application all over again.
  3. You might need to sue the government. This happens if you believe the government has made an arbitrary decision in your case, and you’ll take the case to district court to hopefully get an approval.

So these are a few things that you can do.
